Do You Qualify for Workers’ Compensation Benefits?

  • Workers’ compensation laws help streamline the claims process for injured workers. There are workers’ compensation laws in every state, and all states but Texas require most employers to participate in the program. Even in Texas, most employers subscribe to the state workers’ compensation program, and more than 80% of employees work for an employer who is a subscriber.
  • To qualify for workers’ compensation, you must prove only two things: that you were injured and that the injury occurred during the course of your employment. Unlike other personal injury claims, you don’t have to prove that your employer acted carelessly or wrongfully. If your claim is approved, you can generally start receiving benefits within a few weeks.

How Are Your Workers’ Compensation Benefits Calculated?

While there are separate federal workers’ compensation programs, most workers’ compensation is governed by state laws. Accordingly, benefits calculation can vary from jurisdiction to jurisdiction. As a general rule, though, workers’ compensation benefits are based on:

  • Your average weekly wage (AWW) over a particular period of time, typically the previous 26 or 52-week period
